Welcome to Orbital Archive! The terms “we”, “us” and “our” refer to Orbital Archive. Orbital Archive operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Orbital Archive is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or state of residence. You are solely responsible for maintaining the security of your account credentials and for all activity occurring under your account.

SECTION 2 - OUR PRODUCTS

All products at Orbital Archive are custom-printed and made-to-order. Because each item is created specifically for you, production times typically take 2–7 business days before dispatch. We engage trusted production partners, specifically Printful Inc. and Printify Inc., for the physical manufacturing and delivery of orders. We have made every effort to accurately represent our products, but colors and placement may differ slightly from how they appear on your screen due to device settings and the nature of print-on-demand. We reserve the right to discontinue any product or limit quantities at any time.

SECTION 3 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. Because our fulfillment process begins shortly after purchase to ensure fast delivery, we accept cancellation requests strictly within 2 hours of your order being placed. After this 2-hour window, the order has entered production and cannot be canceled. Your purchases are subject to return or exchange solely in accordance with our Refund Policy, which includes specific provisions for EU/UK customers.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. Unless otherwise stated, posted prices do not include taxes, shipping, handling, or customs charges. You agree to provide current, complete, and accurate purchase information and to update your account promptly so we can complete your transactions.

SECTION 5 - SHIPPING AND DELIVERY

Orders are dispatched from the facility closest to the delivery address. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you. Buyers are responsible for any customs and import taxes that may apply upon delivery.

SECTION 6 - INTELLECTUAL PROPERTY

All artwork, designs, logos, and text are owned by Orbital Archive. While our visual records are conceptualized with advanced AI tools, they are refined by a human curator and protected as original creative works. You must not reproduce, distribute, or modify any material on the Services without our prior written consent.

SECTION 7 - THIRD-PARTY TOOLS AND LINKS

We may provide access to third-party tools (like sizing charts or tracking apps) and links to third-party websites over which we have no control. Use of these is at your own risk, and we are not responsible for their content or accuracy.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

Orbital Archive is powered by Shopify. You acknowledge that Shopify is not responsible for any aspect of the sales or interactions between you and Orbital Archive.

SECTION 9 - PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our data handling practices, including our sharing of data with production partners to fulfill your orders.

SECTION 10 - FEEDBACK AND REVIEWS

If you submit reviews or feedback, you grant us a perpetual, worldwide license to use and display that content for any purpose, including marketing and store improvement.

SECTION 11 - ERRORS AND INACCURACIES

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

SECTION 12 - PROHIBITED USES

You may not use our products or site for any unlawful purpose, to infringe on intellectual property, or to transmit malicious code.

You agree to indemnify and hold harmless Orbital Archive and its partners from any claims or damages arising out of your breach of these Terms.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada.
